Pursuant to article 5 para. 1 Mediendienste-Staatsvertrag (Media Service Treaty), Fischer Profil GmbH are responsible for their "own content" provided for use, in accordance with the general legislation. Such content must be distinguished from links which point to contents provided by third parties. The company will only accept responsibility for external content if it has knowledge of same (including any illegal or actionable content) and if it is technically possible and reasonable to prevent the use of same (article 5 para. 2 Mediendienste-Staatsvertrag).
Fischer Profil GmbH has checked when first placing a link to external websites whether this link will entail any possibility of prosecution. The company however is not obliged to constantly check linked websites for any changes which might have an impact on their responsibility. Only if Fischer Profil finds that a linked website is illegal or is advised by third parties accordingly, will Fischer Profil remove the link to such website as far as this is technically possible and reasonable. Technical feasibility and reasonableness are not affected by the fact that even after removal of such link from the Fischer Profil GmbH homepage the illegal website may be accessed through other servers.
